| PROPOSITION 90-Repeat (Restoring The American Dream After Kelo) |
being condemned by the government. Think about it. If you’ve ever had your property taken you’ll never be the same. I was condemned in 1963. It’s a life altering experience. I managed a family owned business in the path of the I-5 on-ramp from Balboa in Pacific Beach. After 26 years in business, the bureaucrats put our family business out of business. This is why I’m in real estate, why I was elected to the San Diego City Council, and why I joined Citizens For Private Property Rights. What would you do if the government took away your business through “Redevelopment” or your life’s savings through rent control? Imagine the government downzoning your property to half its value. Imagine if bureaucrats took your home to give to someone else, what they can legally do says the Supreme Court and already are doing to others. How would you feel? Some of you are dismayed that government wants to make it illegal to spank your children and is extending no smoking laws to not only public buildings, parks and beaches, but in your own car if a child is in it, a government can fine you for not wearing seatbelts or not using low-flow toilets. Now it wants to prohibit trans fats and require all animals to have electronic ID Tags by 2009. Recently a law was passed to prohibit free speech 60 days before an election and radio stations that oppose tax increases can be fined. Think not? All the above are either under discussion, being adopted or have been implemented by the very same people in government that have the power to tax you, incarcerate you, and even take your life. None of the above examples, however, gives the government as much power over you as the elimination of property rights, without which no other rights are possible (proven on a massive scale in eastern block countries during the last century). Imagine your children and grandchildren denied the opportunity of growing up in a free society. It's self-evident Democrats or Republicans won't protect your rights. They want to regulate and control you right down to spanking your children, what you eat and do in your own home. The U.S. Supreme Court set off a firestorm across the country when it betrayed the people by ruling in favor of the City of New London against Susette Kelo, allowing her home to be taken and given to someone else promising to pay more taxes. Twenty-nine states have enacted constitutional changes in response to the Kelo decision. Prop. 90 last November was California’s attempt, which sadly failed statewide. Milton Friedman said, “we have the right people in government – the trick is to get them to do the right thing.” Prop. 90-Repeat will force politicians to do the right thing. The only solution to preserving our rights is not by relying on politicians but by setting our rights in concrete through Constitutional Amendments such as the trailblazing tax limiting Proposition 13 (over the objections of nearly all politicians in power at the time). . Citizens For Private Property Rights, with over 900 members, is putting Proposition. 90, The Homeowners Protection Act back on the ballot for just San Diego County where it passed by majority vote. Opposed by nearly all politicians in power, it lost statewide. They said it would cost taxpayers billions of dollars if the government had to pay for all the property it takes. Better to shift the burden to the owners. In fairness, however, if the taking of your property is for the public good then the public should pay for it -- not you. Eternal vigilance is required and there have to be people who step up to the plate, who believe in liberty, and who are willing to fight for it." -- Milton Friedman We have one pledge of $50,000 and another for $10,000 providing we obtain matching funds so we need $140,000 more to gather the necessary signatures. Prop 90-Repeat requires the government to compensate you if it adopts rent control, takes your business or diminishes the value of your property through down-zoning. It will prohibit the taking of your home to give to someone else who promises to pay more in taxes. If not you who will safeguard our liberties and pass them on to the next generation?
